Terms of Service

Gustara ("Platform", "we", "us") is a technology platform that connects customers with independent restaurants. We provide the ordering interface, payment processing, and delivery coordination tools. We are not a restaurant, food manufacturer, or food delivery service ourselves. Each restaurant on Gustara is an independent business responsible for the food it prepares and sells.

By accessing or using the Gustara website, mobile site, or any related services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Platform.

We may update these terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email or a notice on the Platform.

You must be at least 18 years of age to create an account and place orders on Gustara. By using the Platform, you represent that you meet this requirement and that the information you provide is accurate and complete.

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse the Platform in any way.

When you place an order through Gustara, you are entering into a transaction directly with the restaurant. Gustara provides the technology platform for this transaction, but the contract for sale of food is between you and the restaurant.

• Menu items, descriptions, prices, and availability are provided by the restaurant and may change without notice.
• Prices displayed on Gustara reflect the restaurant's own pricing. We do not add commissions or markups to food prices.
• Delivery charges, packaging fees, or applicable taxes will be shown before you confirm your order.
• An order is confirmed only after the restaurant accepts it. You will receive a confirmation via the Platform and/or WhatsApp.

Gustara supports multiple payment methods including UPI, credit/debit cards, net banking, and cash on delivery (where available). Payment processing is handled by third-party payment gateways (such as Razorpay or Cashfree) and is subject to their terms.

By making a payment, you authorize us to charge your selected payment method for the total order amount, which includes food cost, any delivery or packaging charges, and applicable taxes. All prices are in Indian Rupees (INR).

Standard payment gateway processing fees apply (e.g., UPI transactions may incur a fee of 0.5-1%, and card transactions 1.5-2%). These are industry-standard charges levied by payment processors, not by Gustara.

Cancellations and refunds are governed by our Cancellation & Refund Policy. In summary:

• You may cancel an order before the restaurant begins preparation, at no charge.
• Once preparation has started, cancellation may not be possible or may result in a partial refund.

Delivery is handled by the restaurant's own delivery staff, coordinated through the Gustara Rider platform. Estimated delivery times are approximate and may vary based on distance, traffic, weather, and restaurant preparation time.

Gustara is not liable for delays or issues arising during delivery, though we will work with the restaurant to resolve any concerns.

Restaurants on Gustara are responsible for food preparation, quality, hygiene, and compliance with FSSAI regulations. Each restaurant is required to hold a valid FSSAI license, which is displayed on their storefront page.

If you experience any food quality or safety issue, please contact us immediately through our Contact page. We take food safety complaints seriously and will work with the restaurant to investigate and resolve the issue.

All content on the Gustara Platform, including the design, text, graphics, logos, and software, is the property of Gustara or its licensors. You may not reproduce, distribute, or create derivative works from any Platform content without prior written permission.

Restaurant names, logos, menu content, and food images belong to the respective restaurants and are used on the Platform with their authorization.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Place fraudulent orders or provide false delivery information.
• Attempt to interfere with the Platform's operation, security, or other users' experience.
• Scrape, harvest, or collect data from the Platform without authorization.
• Impersonate another person or entity.

To the maximum extent permitted by law, Gustara shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to food quality issues, delivery delays, or payment processing errors.

Our total liability for any claim related to the Platform shall not exceed the amount you paid for the specific order giving rise to the claim.

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We make no representations about the accuracy or completeness of restaurant information, including menus, prices, and availability.

These terms are governed by the laws of India. Any disputes arising from or relating to these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala.

Before initiating any formal proceedings, we encourage you to reach out through our Contact page to attempt an amicable resolution.

We reserve the right to modify these terms at any time. When we make material changes, we will notify registered users via email and update the "Last updated" date at the top of this page. Your continued use of the Platform after such changes constitutes acceptance of the new terms.
